These terms govern your use of the Up There app, developed by Neil Anderson. By downloading or using the app, you agree to them.
In addition to these terms, your use of the app is subject to Apple's standard Licensed Application End User License Agreement (EULA). If these terms conflict with the Apple EULA, the Apple EULA controls.
The app
Up There gives you a nightly naked-eye sky briefing—a verdict, a target, a direction, and a time window—for the Moon and the naked-eye planets. It is free to use, has no accounts, and has no in-app purchases at this time.
Not a safety or navigation tool
Up There is intended for casual, recreational stargazing. Its verdicts, timing, and positions are estimates for a general naked-eye audience, not precise scientific measurements, and its weather assessment reflects Apple Weather's forecast at the time you check it. Don't rely on the app for navigation, safety-critical decisions, or professional or scientific purposes.
Weather and location data
Sky conditions come from Apple's WeatherKit, and location (when you grant it) comes from Core Location. We don't control the accuracy, availability, or timeliness of either service, and the app may occasionally show stale or unavailable data rather than a live reading.
Acceptable use
Use Up There for personal, non-commercial stargazing. Don't attempt to reverse-engineer, scrape, or interfere with the app's operation.
Intellectual property
The app, including its design, copy, and code, is owned by Neil Anderson. You may not copy, redistribute, or resell the app or its assets. Screenshots of your own sky briefings for personal or social sharing are welcome.
Disclaimer
The app is provided “as is”, without warranties of any kind. To the maximum extent permitted by law, Neil Anderson is not liable for any damages arising from use of the app, including decisions made about whether or when to go outside.
Changes
We may update these terms; the current version will be posted at this page with a revised effective date. Continued use of the app after changes constitutes acceptance.
